Terms and Conditions for Tutors and Clients
1. Acceptance of Terms and Conditions for Tutor
1.1 By registering as a tutor with GoTutor or accepting a tuition assignment, you agree to the Terms and Conditions outlined below regarding our tuition matching service. This engagement is considered formalized once a Confirmation Note is sent to you via WhatsApp, SMS, Email, or upon the completion of your first tuition lesson as arranged with the client.
2. Registration as a Tutor
2.1 All tutors registering with GoTutor must be at least 16 years old and have attained a minimum of a GCE “O” Level qualification or its equivalent.
3. Qualifications and Authentication of Documents from Tutors
3.1 All tutors are required to provide accurate information regarding their academic qualifications and personal details. Clients reserve the right to request verification of these documents at any time. Tutors found to have submitted false qualifications or certifications will be reported to the police.
4. General Guidelines for a Tutor
Tutors must maintain professionalism and uphold ethical standards. Should a tutor’s conduct be deemed unsatisfactory, actions may be taken, including but not limited to termination of ongoing and future assignments.
4.1 Adherence to Agreed Rates and Timeslots
• Tutors must honour the agreed lesson rates and scheduled times.
• Any changes must be mutually agreed upon with the client.
• For rescheduling, at least 48 hours’ notice should be provided.
• In cases where this is not possible (e.g., sudden illness), an MC (medical certificate) may be requested by the client for accountability.
4.2 Lesson Location
• Tutors must be fully aware of and agreeable to the lesson address/location before accepting an assignment.
• Transport arrangements and travel time should be planned in advance to ensure punctuality.
• Tuition lessons must be conducted at the designated address specified in the assignment.
4.3 No Substitution
• Tutors must conduct lessons personally and are not permitted to send any representative or substitute under any circumstances.
4.4 Professional Conduct
• Tutors are expected to conduct themselves in a professional and ethical manner throughout the assignment.
4.5 Punctuality
• Tutors should arrive on time and ensure that lessons are conducted in full, without shortening the agreed duration.
4.6 Commitment to Assignments
• Tutors are expected to commit to assignments for a minimum of three months unless the assignment specifies a short-term duration.
4.7 Strict Prohibition of Abuse and Unlawful Conduct
• Any form of physical or verbal abuse toward students or parents is strictly prohibited. This includes, but is not limited to, other unlawful actions. Any violations will be reported to the law enforcement authorities.
5. Discontinuation of Tuition Assignments
5.1 Clients reserve the right to request a change of tutor at any time. If tuition assignment is terminated or the tutor is changed within the first 4 weeks of lessons at the client’s request, GoTutor will receive the first two weeks of the tuition fees for the lessons conducted. The third and fourth weeks’ tuition fees, where applicable, will be paid directly to the tutor.
However, there are situations where the tutor will not be entitled to their third and fourth weeks’ tuition fees, including but not limited to:
• Cancellation of the assignment initiated by the tutor.
• Failure to conduct lessons to a reasonable and satisfactory standard.
• Providing false or inaccurate information in the tutoring profile.
• Failure to provide supporting documentation to substantiate qualifications or claims stated in the tutoring profile (e.g., academic certificates).
5.2 GoTutor will assess each case, considering the facts, circumstances, and the interests of all parties involved. As the coordinating agency, GoTutor retains the sole discretion to make the final decision on such matters.
6. Commitment Period, Schedule, Payment, Postponement and Cancellation of Lessons Arrangements
6.1 Length of Commitment
• Once a tutor confirms via SMS, WhatsApp, email, or phone call, they are expected to commit to a minimum of 3 months of lessons for a Long-term Assignment, or 4 weeks of lessons for a Short-term Assignment.
6.2 Schedule, Payment and other Arrangements
• After the first lesson is conducted, the tutor is responsible for:
o Arranging directly with the client for the second lesson and subsequent lessons.
o Clearly communicating any personal, payment, or cancellation terms to the client, other than for the first two weeks of lessons.
6.3 Postponement of Lessons
• Tutors must inform the client at least 2 days in advance if a postponement is needed.
• In cases of sudden illness, a medical certificate (MC) may be required to be shown to the client.
• Rescheduling is allowed only with mutual agreement between the tutor and the client.
6.4 Last-Minute Cancellations or Reschedule
• First Lesson: If a client cancels or reschedules less than 2 hours before the scheduled lesson, they must pay 50% of the lesson fee to cover the tutor’s transport costs and time.
• Subsequent Lessons: Tutors should communicate their personal cancellation policies to the client in advance. Any issues related to cancellations are handled directly between the tutor and client, outside the agency’s responsibility.
7. Long-Term Assignments
7.1 Any assignment not explicitly stated as a Short-Term Assignment will be considered a Long-Term Assignment by default. Tutors should not independently determine whether an assignment is short-term or long-term. This classification is decided solely by GoTutor and communicated prior to assignment confirmation.
7.2 For Long-Term Assignments that are terminated prematurely for any reason (e.g., unsuitability, location issues, personal circumstances), the assignment will not be reclassified as short-term. Unless otherwise stated, tutors are expected to commit to assignments on a long-term basis, generally for a minimum period of three months.
8. Commission and Payment of Tutor Fees (Long-Term Assignment)
8.1 Tutors are strongly encouraged to factor in GoTutor’s commission when quoting their rates during assignment applications. The tuition rates agreed upon at the point of lesson confirmation shall remain fixed. However, tutors may revise their rates if the student progresses to a higher academic level. Any such adjustments should be clearly communicated directly to the client by the tutor and must be mutually agreed upon before implementation.
8.2 GoTutor collects a one-time commission equivalent to the first two weeks of lessons from its tutors. This commission is collected directly from the client, and no further action is required from the tutor.
8.3 If any additional tuition services are added during the first month, for example, lessons for the student’s siblings or the addition of new subjects. These must be reported to GoTutor. Such additional services will also be subject to the same commission terms.
8.4 A confirmation note and invoice will be issued upon the successful confirmation of each tuition assignment.
• Upon completion of the first two weeks of lessons, clients are required to make payment for the first two weeks’ fees directly to GoTutor.
• Subsequent payments will be made directly to the tutor.
8.5 In cases where the client is unwilling or unable to transfer the first two weeks’ tuition fees to GoTutor, the client have to inform GoTutor in advance and the tutor will be required to:
• Collect the payment from the client on GoTutor’s behalf.
• Transfer the due commission amount to GoTutor at the earliest possible time.
9. Short-Term Assignments
9.1 Assignments lasting 11 weeks or less are classified as Short-Term Assignments.
10. Commission and Payment of Tutor Fees (Short-Term Assignment)
10.1 GoTutor collects a one-time commission equivalent to the first week’s lesson from its tutors. This commission is collected directly from the client, and no further action is required from the tutor.
10.2 Tutors are strongly encouraged to maintain a clear, client-acknowledged record of all lessons conducted.
11. Discontinuation of Assignment (Short-Term Assignment)
11.1 If a short-term assignment is discontinued by Client within first two weeks, GoTutor will collect first week of the tuition fees for the lessons conducted. The second week’s tuition fees, where applicable, will be paid directly to the tutor.
11.2 All cases will be considered on an individual basis, with GoTutor reserving the right to make the final decision.
12. Collusion & Fraud
12.1 Any attempt to circumvent the commission payable to GoTutor, in any manner, is strictly prohibited and deemed unlawful. GoTutor maintains a zero-tolerance stance on fraudulent and unethical conduct. Any suspected breaches will be promptly reported to law enforcement authorities, and civil legal action will be pursued to recover all losses resulting from such fraudulent activities.
13. Disclaimer
13.1 GoTutor reserves the right to amend the Terms and Conditions at any time without prior notice.
14. Privacy Policy
14.1 At GoTutor, we highly value the privacy of both our tutors and clients. We handle all personal information with the utmost confidentiality and respect. This notice outlines our privacy practices. By using GoTutor’s services, you acknowledge and agree to the terms described in this policy.
15. Consent on Collection, Usage & Disclosure of Personal Data
15.1 By registering as a tutor with GoTutor, you consent GoTutor to collect, use, and disclose your personal data for the purposes stated below, in accordance with the Personal Data Protection Act:
• Consent to receiving available tuition assignments via various communication channels, including but not limited to WhatsApp, SMS, Telegram, and Email.
• Consent to your relevant personal information being shared with the respective client upon confirmation of a tuition assignment.
• Consent to receiving tutor-related marketing messages through email or messaging platforms, including but not limited to WhatsApp, SMS, Telegram, and Email.
16. Use and Disclosure of Personal Information (For Tutors and Clients)
16.1 GoTutor will not rent, sell, or share your personal information with any third party, except as necessary to provide the products or services you have requested. We will not publicly disclose any sensitive information such as your NRIC, uploaded certifications, phone number, or full address, except when required to deliver our services to the following parties:
• Client
A client is an individual who requests a tutor through GoTutor. The tuition-related information provided by the client (location, subject, lesson frequency, other information excluding personal information) may be shared with tutors to assist in finding a suitable match. The client’s full address and contact number will only be disclosed to the tutor once the lesson has been confirmed.
• Tutor
A tutor is an individual who registers with GoTutor for tuition assignments. The general information relevant to tuition assignments such as your qualifications, gender, experience and other personal information may be revealed to clients to facilitate the selection process. Personal information such as your contact number, full name in NRIC will not be shared with clients until the lesson has been confirmed.
17. Legal Disclaimer
17.1 While GoTutor makes every effort to protect the privacy of our clients and tutors, we will comply with any lawful request or requirement from authorities to disclose personal information.
18. Changes To This Privacy Policy
18.1 This policy may be updated or amended at any time without prior notice. If you have any questions or concerns regarding our privacy policy, please feel free to contact us at contact@gotutor.sg.
